Legal Challenge Threatens Abdullah Zeydan’s Election Victory in Van Metropolitan Municipality

The legal battle surrounding Abdullah Zeydan, the pro-Kurdish People’s Equality and Democracy Party (DEM) co-mayoral candidate for the Van metropolitan municipality, has taken a dramatic turn as the Ministry of Justice challenges the restoration of his civil rights. This challenge comes just days after Zeydan’s party achieved a historic victory in Van, winning all 14 local councils in the province.

The last-minute attempt by the Ministry of Justice to strip Zeydan of his right to stand for election has sparked major political mobilisation, with DEM Party leaders and MPs planning to protest in person in Van city. The party has condemned the Ministry’s objection as an affront to the democratic process and a disregard for the will of the people.

Despite the Supreme Election Board confirming Zeydan’s eligibility to stand for election, the Ministry’s objection has led to a legal challenge against the decision to restore his banned rights. The reversal of the court’s decision has effectively reinstated the ban on Zeydan’s civil rights, including his right to participate in elections.

The DEM Party has demanded an immediate retraction of this “unlawful decision,” calling it illegal and a threat to democracy. They have urged all democratic forces to oppose this attempt to overturn the will of the people and uphold the principle of respect for the people’s choice.

The legal framework surrounding the restoration of prohibited rights, also known as the Restoration of Forfeited Rights, aims to remove deprivations of rights established by laws other than the Turkish Penal Code after a person has served their sentence. Zeydan, who was previously sentenced to eight years in prison for allegedly supporting an illegal organisation, was released in January 2022.

The unfolding legal battle adds a new layer of complexity to the political landscape in Van, as Zeydan and the DEM Party continue to fight for their right to participate in the democratic process. The outcome of this legal challenge will have far-reaching implications for the future of democracy in the region.
