South Africa’s Genocide Case Against Israel: ICJ Public Hearings Begin

In a groundbreaking move, South Africa has filed a case against Israel at the International Court of Justice (ICJ), accusing the country of committing genocide in the Gaza Strip. The case, which is set to begin with two days of public hearings on Thursday, marks the first time the ICJ will address the siege on Gaza, where over 23,000 people, including nearly 10,000 children, have been killed since October 7.

South Africa’s application, submitted on December 29, alleges that Israel has violated the 1948 UN Genocide Convention by killing civilians, displacing Palestinians en masse, and destroying their homes. The suit also highlights the blockade on food and essential health services for pregnant women and babies as measures intended to bring about the destruction of Palestinians as a group.

The hearings at the ICJ will focus on an emergency request by South Africa for the court to urgently order the Israeli military out of Gaza and to stop the indiscriminate bombing of civilians. While the court could issue an order in weeks if approved, a full judgement on whether Israel has committed genocide in Gaza is expected to take years.

Israel has denied the allegations and has promised to defend itself in court. The ICJ, which focuses on legal disputes between states, will determine if it has jurisdiction in the case at the preliminary hearings. The court’s judgements are legally binding and cannot be appealed, but enforcement can be a challenge as the ICJ lacks real enforcement power.

The case has already garnered international attention, with countries like Malaysia, Turkey, and Bolivia expressing support for South Africa. The US, a staunch ally of Israel, has defended the country in statements. The outcome of the case could have significant implications for accountability and international pressure on Israel to halt its military campaign in Gaza.
