Nicola Macara, an associate at Clyde & Co, has laid out her predictions on what we are likely to see on employment law if Labour wins the next general election. With polling indicating a majority Labour government on current voting intention, it is important to consider the potential changes that could be made in areas such as employment law.

In a Labour Party document published in January, the party leader committed to delivering a genuine living wage, banning zero hours contracts, and ending fire and rehire practices. The Labour Party deputy leader also pledged to bring forward an employment rights bill within the first 100 days of a majority Labour government to legislate for these changes.

One of the key commitments is the implementation of a genuine living wage that would cover all individuals 18 or over equally, as opposed to the current National Minimum Wage rates based on age. Additionally, Labour plans to make zero hours contracts unlawful and provide workers with a right to a regular contract after working regular hours for twelve weeks or more.

The practice of “fire and rehire,” where employers dismiss and re-employ workers on less favorable terms, would also be made unlawful under Labour’s plans. The party aims to enhance information and consultation procedures for employers seeking agreement on contractual changes and provide redress for workers who are dismissed for failing to agree to new terms.

Furthermore, Labour intends to grant workers rights to sick pay and parental leave, as well as protection against unfair dismissal from the first day of employment. The party also plans to repeal the Strikes (Minimum Service Levels) Act 2023, which has allowed regulations requiring a minimum level of service during industrial action.

As the date for the next general election approaches, it will be important to study the political parties’ manifestos for further details on their intentions for employment and discrimination law. With Labour’s commitment to leveling up workers’ rights in a significant way, the role of these proposed reforms will be a key factor in the upcoming election.
