Tribunal rules in favor of legal secretary who experienced unwanted sexual conduct

Legal Secretary Subjected to Sexual Harassment by Boss, Tribunal Finds

The employment tribunal ruling on the case of legal secretary Megan Bratt against her boss Marcus Hall has shed light on the importance of maintaining a respectful workplace environment. Bratt, who worked at JGQC Solicitors in Lincoln, resigned after just seven weeks due to the unwanted conduct of a sexual nature she experienced from Hall.

Judge Wilson, presiding over the tribunal, dismissed the firm’s argument that the behavior was simply office banter, emphasizing that the inappropriate and offensive comments made by Hall created an offensive environment for Bratt. The judge found that Bratt’s complaint of sexual harassment was well founded and ruled in her favor.

Several incidents were highlighted during the tribunal, including Hall sending Bratt a message with kisses and referring to his past sexual relationships in explicit detail. Bratt also felt uncomfortable when Hall commented on her appearance and showed her provocative images on social media.

The judge emphasized that workplace behavior cannot be excused as banter or jokes if it makes an employee feel uncomfortable or harassed. It was noted that Bratt did not feel safe raising her concerns in the office, and her colleagues did not provide a supportive environment for her.

The tribunal’s ruling serves as a reminder to employers and employees alike that creating a respectful and inclusive workplace is crucial. The case was stayed for 40 days to allow for an agreed settlement to be implemented, signaling a potential resolution to the matter.
