Probate practitioners in England and Wales can now use MyHMCTS for online case management

Probate practitioners in England and Wales can now use MyHMCTS for online case management. Before you can start using MyHMCTS, there are a few steps you need to complete:

  1. Set up HMCTS Payment by Account (PBA)
  2. Register your organisation with MyHMCTS
  3. Set up your MyHMCTS user account

For detailed information and instructions, you can refer to the MyHMCTS registration guidance. If your organisation already has an account, contact the administrator to create your account.

Once you have a MyHMCTS account, you can sign in using your email address and password here.

If Inheritance Tax needs to be paid

If Inheritance Tax needs to be paid, you must follow these steps:

  1. Send the IHT400 form to HMRC
  2. Wait 20 working days for HMRC to send you a letter with a code

When you apply, you will be required to enter the code provided by HMRC. Your application cannot be completed and submitted until you have received this code. If you haven’t received the letter after 20 working days, you must contact HMRC at the Inheritance Tax helpline: 0300 123 1072.

Create a case

Case type and eligibility

Once you sign in to MyHMCTS, you will see your case list, which will be empty initially. To start your application, select ‘Create case’ and follow the instructions to select the jurisdiction, case type, and event. Make sure to read the information provided about grant of probate applications and exemptions before proceeding.

Provide your organisation’s details and check for accuracy before saving and continuing. You can always make changes later. Once completed, you can proceed to add deceased details.

Provide the necessary information about the deceased, including Inheritance Tax details and estate values. Depending on the date of death, you may need to complete additional steps related to Inheritance Tax forms and unique probate codes from HMRC.

Choose the application type (grant of probate, letters of administration, etc.) and answer any relevant questions before saving and continuing. Review your answers and proceed to the next steps as instructed.

Complete your application

Legal statement

Review the legal statement based on your answers and make any necessary changes. Once satisfied, send the legal statement to the applicants for their signature. You can sign on their behalf if authorized. Proceed to confirmation and statement of truth.

Upload the legal statement and confirm that the applicants agree with it. Sign the statement of truth and proceed to submit and pay for the application.

Submit and pay for the application

Pay the application fee and submit your application. Follow the instructions for payment and document submission. Once all checks are completed, the grant will be issued and sent to you.

Find and track the progress of your case

You can track the progress of your application on the MyHMCTS platform. Use the case list and event history to monitor the status of your case. Different statuses indicate the stage of your application, from creation to grant issuance.

Delete unsubmitted applications

If needed, you can delete unsubmitted applications on MyHMCTS. Follow the steps provided to delete a case that has not been submitted for processing.
