Understanding International Humanitarian Law in the Israel-Palestine Conflict: A Legal Analysis

The recent hostilities between Israel and Palestinian armed groups have raised significant concerns about the application of international humanitarian law (IHL) and the commission of war crimes. As accusations of violations mount, it is crucial to understand the legal framework governing armed conflict and military occupation.

IHL, also known as the laws of war, sets out rules that bind states and non-state armed groups involved in conflicts. These rules require parties to distinguish between combatants and civilians, protect civilians from harm, and ensure humane treatment of those in custody. Violations, such as targeting civilians or imposing collective punishment, are never justified.

In the case of the ongoing conflict between Israel and Palestinian armed groups, both sides have been accused of committing war crimes. Deliberate attacks on civilians, taking hostages, and indiscriminate bombings are among the violations documented. The use of white phosphorus by Israeli forces and the collective punishment of Gaza’s population are also considered war crimes.

Israel’s occupation of the West Bank and Gaza has been a subject of international scrutiny, with concerns raised about the treatment of the Palestinian population. The occupying power is required to meet the basic needs of the population and ensure their protection. The long-standing occupation has also raised questions about the legal responsibilities of both Israel and Palestinian governing authorities.

Accountability for war crimes and other international crimes is essential to ending the atrocities committed in the region. The International Criminal Court (ICC) has jurisdiction over crimes committed in or from the Occupied Palestinian Territory and has an ongoing investigation into possible violations. Effective accountability mechanisms are crucial in ensuring justice for victims and preventing future atrocities.
