Oil companies are finally set to stand trial in lawsuits brought by state and local governments over the damages caused by climate change after years of legal appeals and delays. Dozens of governments have brought new claims against the fossil fuel industry as initial cases inch closer to the courtroom.

According to Richard Wiles, president of the Center for Climate Integrity, the cases are building toward more legal action in more places using various legal theories to hold oil companies accountable. The lawsuits cite extensive news reporting showing that oil companies knew about the dangers of climate change decades ago but tried to undermine scientific consensus.

The claims argue violations of laws including consumer protection, public nuisance, failure to warn, fraud, and racketeering. Some seek to force oil companies to help pay for climate change damages, impose penalties for deceptive practices, or fund corrective education campaigns.

Experts believe the lawsuits could put the oil industry on the hook for billions of dollars given the massive costs of climate disasters and government adaptation efforts. However, the legal battle is expected to be long and arduous, with some predicting it could take decades to reach a resolution.

Oil companies have tried to move the cases to federal court, but recent court decisions have ruled that they belong in state court, clearing the way for jury trials. Environmental advocates hope that the first trials could lead to a “tidal wave” of new cases similar to the tobacco industry settlement in the 1990s.

While oil industry supporters argue that holding companies accountable for climate change will hurt consumers, governments are pushing forward with their lawsuits. The first trials are expected to take place in Massachusetts and Boulder County, Colorado, with more cases close behind.

The legal battles highlight the challenges faced by plaintiffs in taking on the powerful oil industry, with experts calling it a “war of attrition.” Despite the steep costs and delays, momentum is growing as more governments join the fight against climate change.
